TRADUCTIONS EN CONTEXTE

Wat betreft de goedkeuring en uitvoering van het acquis en overeenkomstig het MIPD zijn projecten geselecteerd op basis van hun prioriteit met betrekking tot de toetredingsonderhandelingen en de voorbereidingen, in het licht van de grote investeringen die nodig zijn voor de harmonisatie van de wetgeving en voor terreinen waar een zeer grote hoeveelheid wetgeving moet worden omgezet.

Coupled with the fragmentation of the internal market, this calls for further harmonisation of laws across the Member States, in particular by eliminating gaps and weaknesses in applicable EU legislation, notably the Unfair Commercial Practices Directive and the Unfair Contract Terms Directive in terms of consumer protection, and the E-Commerce Directive when it comes to exemptions from private copy levies.

Notes with satisfaction that the European Union's power is strengthened considerably in the field of public health by way of references to health services in cross-border areas, measures related to the protection of public health regarding tobacco and the abuse of alcohol, and on monitoring, early warning of and combating serious cross-border threats to health, excluding harmonisation of laws and regulations, as well as measures related to medicinal products and devices for medical use. Welcomes specific references to initiatives aimed at establishing guidelines and indicators, organising the exchange of best practices and preparing the necessary elements for periodic monitoring and evaluation, concerning which the European Parliament is to be kept fully informed. I would like to highlight on the basis of my own working experience a number of things that I find lacking in the work and legislative programme, namely initiatives that the Commission has promised in other contexts, but are not to be found here, such as the standardisation of the consumer protection acquis, the term of protection of copyright, further developments in patent law and the applicability of EU law in sport.

Proposes that the forthcoming revision of Directive 93/22/EEC should provide for Member States to grant a right of access for investment firms from other Member States to central counterparty, clearing and settlement systems in their territory and that those systems should be subject to the transparent and objective criteria applicable to local participants; proposes that an information statement be drawn up identifying the fundamental differences between the Member States" laws affecting clearing and settlement systems, in order to guide market participants; considers that in the long-term the creation of a securities code could be envisaged; takes the view, however, that this should be a long-term goal, since it is not feasible in the short term due to the necessity of dealing with differences concerning the legal framework for sensitive issues such as company law, property rights and insolvency law; proposes that a working party of securities experts should be set up rapidly to study in detail the questions raised by harmonisation of securities legislation in the EU and to propose solutions to the abovementioned differences;
