De Europese Commissie heeft Polen voor het Hof van Justitie van de Europese Unie gedaagd omdat het land geen nationaal elektronisch register van wegvervoerondernemingen heeft ingesteld en dat register niet heeft gekoppeld aan de nationale elektronische registers van de andere EU-lidstaten, zoals artikel 16, leden 1 en 5, van Verordening (EG) nr. 1071/2009 voorschrijft.

Statutory auditors and audit firms shall keep the documents and information referred to in Article 4(3), Article 6, Article 7, Article 8(4) to (7), Articles 10 and 11 Article 12(1) and (2), Article 14, Article 16(2), (3) and(5) of this Regulation, and in Articles 22b, 24a, 24b, 27 and 28 of Directive 2006/43/EC, for a period of at least five years following the creation of such documents or information.

The control system involves systematic physical controls (100%) and requires a certificate of analysis on radioactivity contamination levels (confirming that radioactivity is within certain limits) as a condition for completing the import procedure of each wagon is, in the absence of a proper risk assessment, contrary to the obligations provided for in Articles 3(1) to (d), Article 3(2), Article 15(1) and Article 16(2) of Regulation (EC) N° 882/2004 on official controls.

3. Without prejudice to paragraphs 4 and 5, Article 16(2) and (3), Articles 17 and 19 to 21, Articles 36 to 43, Articles 54 to 56, Articles 60(3) and 63(4), and Article 64 shall not apply with respect to the auctions conducted by an auction platform appointed pursuant to Article 26(2) or 30(2).

2. 2. For each freight corridor, the infrastructure managers concerned and, where relevant, the allocation bodies as referred to in Article 14(2) of Directive 2001/14/EC, shall establish a management board responsible for taking the measures as expressly provided for in paragraph 6 of this Article and in Articles 8, 10, 12(1), 13(2), (5) and (6), 15(1), 16 and 17(2) and (3) of this Regulation.
