In the event that the General Court should find, contrary to the arguments put forward in the context of the first plea in law, that the second paragraph of Article 5 of Regulation (EC) No 1049/2001 has to be interpreted as meaning that the transmission, by a Member State to an institution of the European Union, of a request for access to a document which is held by that Member State empowers that institution to take a binding decision in regard to that request, the applicant submits that Article 5, thus construed, cannot be based on Article 15(3) TFEU or on Article 255 EC as its proper basis and is for that reason invalid.

When a Member State refers a request to the Council, it shall be handled in accordance with Articles 7 and 8 of Regulation (EC) No 1049/2001 and the relevant provisions of this Annex.

2. The requested State shall, within 10 calendar days after receiving the application and in writing, inform the requesting State of its consent to the transit operation, confirming the point of entry and the envisaged time of admission, or inform it of the transit refusal and of the reasons for such refusal.

4. Without prejudice to Article 6(1), in cases where the completion of transit operations cannot be ensured, despite the assistance provided for in accordance with paragraphs 1 and 2, the requested Member State may, upon request by and in consultation with the requesting Member State, take all the necessary assistance measures to continue the transit operation.

1. Het verzoek om al dan niet begeleide doorgeleiding door de lucht en de daarmee verbonden ondersteuningsmaatregelen uit hoofde van artikel 5, lid 1, moet schriftelijk door de verzoekende lidstaat worden ingediend.
1. The request for escorted or unescorted transit by air and the associated assistance measures under Article 5(1) shall be made in writing by the requesting Member State.
