IN-CONTEXT TRANSLATIONS

Deze besluiten zijn achterhaald door de inwerkingtreding van Verordening (EG) nr. 377/2004, waarbij een gemeenschappelijke kader werd ingesteld voor de detachering van immigratieverbindingsfunctionarissen in derde landen, Verordening (EG) nr. 562/2006, waarbij gemeenschappelijke maatregelen werden ingevoerd voor het grenstoezicht aan de buitengrenzen, en Besluit 2009/371/JBZ, waarbij Europol werd belast met specifieke taken op het gebied van uitwisseling van informatie, onder meer over de bestrijding van irreguliere migratie.
Those decisions became obsolete after the entry into force of Regulation (EC) No 377/2004 that established the common framework for posting immigration liaison officers in third countries, Regulation (EC) No 562/2006 which provided for a set of common measures on the control at external borders and the Council Decision 2009/371/JHA that entrusted Europol with specific tasks related to the exchange of information, including on countering irregular migration.

Overeenkomstig de mededeling van de Commissie van 29 juni 2011 met als titel "Een begroting voor Europa 2020", waarin wordt aanbevolen de financieringsinstrumenten van de Unie te rationaliseren en te vereenvoudigen en scherper de nadruk te leggen op de meerwaarde van de Unie en op de effecten en resultaten, wordt bij deze verordening een programma van de Europese Unie voor werkgelegenheid en sociale innovatie ("het programma") ingesteld om de voortzetting en ontwikkeling te garanderen van activiteiten die worden uitgevoerd uit hoofde van Besluit nr. 1672/2006/EG van het Europees Parlement en de Raad , Verordening (EU) nr. 492/2011 van het Europees Parlement en de Raad , Uitvoeringsbesluit 2012/733/EU van de Commissie en Besluit nr. 283/2010/EU van het Europees Parlement en de Raad waarbij een Europese Progress-microfinancieringsfaciliteit voor werkgelegenheid en sociale insluiting werd ingesteld ("de Faciliteit").
In line with the Commission Communication of 29 June 2011 entitled 'A budget for Europe 2020', which recommends rationalising and simplifying the Union's funding instruments and sharpening their focus both on Union added value and on impacts and results, this Regulation establishes a European Union Programme for Employment and Social Innovation ('the Programme') to provide for the continuation and development of activities carried out on the basis of Decision No 1672/2006/EC of the European Parliament and of the Council , Regulation (EU) No 492/2011 of the European Parliament and of the Council , Commission Implementing Decision 2012/733/EU and Decision No 283/2010/EU of the European Parliament and of the Council that established a European Progress Microfinance Facility for employment and social inclusion ('the Facility').

De verordening van de Commissie waarbij het nieuwe onderzoek wordt geopend, wijzigt de verordening waarbij het recht is ingesteld, door dit recht ten aanzien van de betrokken nieuwe exporteur in te trekken en voor te schrijven dat de invoer overeenkomstig artikel 14, lid 5, dient te worden geregistreerd zodat, mocht tijdens het nieuwe onderzoek dumping met betrekking tot deze exporteur worden vastgesteld, antidumpingrechten kunnen worden geheven met terugwerking tot de datum waarop dit onderzoek is geopend.
The Commission regulation initiating a review shall repeal the duty in force with regard to the new exporter concerned by amending the Regulation which has imposed such duty, and by making imports subject to registration in accordance with Article 14(5) in order to ensure that, should the review result in a determination of dumping in respect of such an exporter, anti-dumping duties can be levied retroactively to the date of the initiation of the review.

In de verordening waarbij het recht wordt ingesteld, wordt het recht voor elke leverancier vermeld of, indien dit niet praktisch mogelijk is, en in het algemeen wanneer artikel 2, lid 7, onder a), van toepassing is, het land van levering.
The Regulation imposing the duty shall specify the duty for each supplier or, if that is impracticable, and in general where Article 2(7)(a) applies, the supplying country concerned.

In de verordening waarbij het recht wordt ingesteld, wordt bekendgemaakt welk recht voor elke leverancier of, indien dit praktisch niet mogelijk is, welk recht voor het land van levering is ingesteld.

(2) Bij arrest van het Hof van Justitie van de Europese Gemeenschappen van 7 september 2006 in zaak C-310/04 is hoofdstuk 10 bis van titel IV van Verordening (EG) nr. 1782/2003 wegens schending van het evenredigheidsbeginsel nietig verklaard, waarbij met name is gewezen op de omstandigheid dat "de Raad, die Verordening (EG) nr. 864/2004 heeft vastgesteld, voor het Hof niet heeft aangetoond dat hij bij de vaststelling van de bij die verordening ingestelde nieuwe steunregeling voor katoen zijn beoordelingsbevoegdheid daadwerkelijk heeft uitgeoefend, wat veronderstelde dat rekening werd gehouden met alle relevante feiten en omstandigheden van de situatie, waaronder de aan de katoenteelt verbonden loonkosten en het voortbestaan van de egreneringsbedrijven, die ter beoordeling van de rentabiliteit van die teelt in aanmerking moesten worden genomen" en dat het Hof niet had kunnen "nagaan of de Gemeenschapswetgever, zonder overschrijding van zijn ruime beoordelingsbevoegdheid ter zake, tot het besluit kon komen dat de vaststelling van het bedrag van de gewasspecifieke betaling voor katoen op 35% van het totaalbedrag van de steun onder de vroegere steunregeling, volstond ter bereiking van de in punt 5 van de considerans van Verordening (EG) nr. 864/2004 uiteengezette doelstelling, namelijk de rentabiliteit en dus de voortzetting van die teelt te verzekeren, welke doelstelling overeenkomt met de in lid 2 van Protocol nr. 4 vermelde doelstelling".
(2) By judgement of the Court of Justice of the European Communities of 7 September 2006 in case C-310/04 Chapter 10a of Title IV of Regulation (EC) No 1782/2003 was annulled for breach of the principle of proportionality, in particular with reference to the circumstance that "the Council, the author of Regulation (EC) No 864/2004, [had] not shown before the Court that in adopting the new cotton support scheme established by that regulation it actually exercised its discretion, involving the taking into consideration of all the relevant factors and circumstances of the case, including all the labour costs linked to cotton growing and the viability of the ginning undertakings, which it was necessary to take into account for assessing the profitability of that crop" and that the Court had not been enabled "to ascertain whether the Community legislature [had been] able, without exceeding the bounds of the broad discretion it enjoys in the matter, to reach the conclusion that fixing the amount of the specific aid for cotton at 35% of the total existing aid under the previous support scheme would suffice to guarantee the objective set out in recital 5 in the preamble to Regulation (EC) No 864/2004, namely to ensure the profitability and hence the continuation of that crop, an objective reflecting that laid down in paragraph 2 of Protocol 4 ".

Bij arrest van het Hof van Justitie van de Europese Gemeenschappen van 7 september 2006 in zaak C-310/04 is hoofdstuk 10 bis van titel IV van Verordening (EG) nr. 1782/2003 wegens schending van het evenredigheidsbeginsel nietig verklaard, waarbij met name is gewezen op de omstandigheid dat "de Raad, die Verordening (EG) nr. 864/2004 heeft vastgesteld, voor het Hof niet heeft aangetoond dat hij bij de vaststelling van de bij die verordening ingestelde nieuwe steunregeling voor katoen zijn beoordelingsbevoegdheid daadwerkelijk heeft uitgeoefend, wat veronderstelde dat rekening werd gehouden met alle relevante feiten en omstandigheden van de situatie, waaronder de aan de katoenteelt verbonden loonkosten en het voortbestaan van de egreneringsbedrijven, die ter beoordeling van de rentabiliteit van die teelt in aanmerking moesten worden genomen" en dat het Hof niet had kunnen "nagaan of de Gemeenschapswetgever, zonder overschrijding van zijn ruime beoordelingsbevoegdheid ter zake, tot het besluit kon komen dat de vaststelling van het bedrag van de gewasspecifieke betaling voor katoen op 35% van het totaalbedrag van de steun onder de vroegere steunregeling, volstond ter bereiking van de in punt 5 van de considerans van Verordening (EG) nr. 864/2004 uiteengezette doelstelling, namelijk dat het bedrag van de gewasspecifieke betaling voor katoen zo wordt berekend dat economische voorwaarden worden gegarandeerd die de voortzetting van activiteit in de voor deze teelt geschikte regio's mogelijk maken en die aldus voorkomen dat katoen door andere gewassen wordt vervangen .

De bijstand van de Gemeenschap aan de landen van Zuidoost-Europa verliep tot op heden voornamelijk volgens Verordening (EG) nr. 1628/96 waarbij het programma OBNOVA werd ingesteld, en Verordening (EG) nr. 3906/89 waarbij het programma PHARE werd ingesteld.

The current Council Regulation No 3760/92 establishing a Community system for fisheries and aquaculture, provides for derogations in respect of the internal market, notably in Articles 6 and 7, which allow derogations from the principle of freedom of access to fishing grounds, so that Member States have the right of exclusive exploitation of their fisheries resources within a 12-mile coastal band, as well as a series of preferential fishing rights, through application of the ‘relative stability’ principle, which distributes national fishing quotas.
