Het Koninkrijk België verzoekt dat het Hof van Justitie van de Europese Unie:
The Kingdom of Belgium claims that the Court of Justice of the European Union should:

Het Gerecht miskent daarbij ook haar motiveringsplicht voorzien in artikel 36, juncto 53, van het Statuut van het Hof door niet te antwoorden op de argumenten ontwikkeld door het Koninkrijk België.
The General Court thus also disregards its obligation to state reasons laid down in Article 36 of the Statute of the Court of Justice, in conjunction with Article 53 thereof, in not responding to the arguments raised by the Kingdom of Belgium.

Minstens miskent het Gerecht de op haar rustende motiveringsplicht door geenszins te verklaren om welk reden al deze ondernemingen zich in een „vergelijkbare feitelijke en juridische situatie” zouden bevinden vanuit staatssteunperspectief, en door de door het Koninkrijk België aangebrachte voorbehouden onbeantwoord te laten.
At the very least, the General Court disregards the obligation to state reasons incumbent upon it by failing entirely to explain why all of those undertakings would be in a ‘comparable factual and legal situation’ from a State-aid perspective, and by leaving unanswered the reservations expressed by the Kingdom of Belgium.

Derde onderdeel: Het Gerecht geeft blijk van een foutieve opvatting waar zij in het bestreden arrest doet uitschijnen dat het Koninkrijk België niet aangeeft waarom de aan- of afwezigheid van overcompensatie juridisch relevant zou zijn voor het bestaan van een economisch voordeel in de zin van artikel 107(1) VWEU.
Third part: The General Court errs in its legal reasoning when, in the judgment under appeal, it appears to suggest that the Kingdom of Belgium fails to state why the presence or absence of overcompensation would be of legal relevance to the existence of an economic advantage for the purposes of Article 107(1) TFEU.
