2. Before making a pyrotechnic article available on the market distributors shall verify that the pyrotechnic article bears the CE marking, that it is accompanied by the required documents, and by instructions and safety information in a language which can be easily understood by consumers and other end-users in the Member State in which the pyrotechnic article is to be made available on the market, and that the manufacturer and the importer have complied with the requirements set out in Article 8(5) and (6) and Article 12(3) respectively.

13. roept de Commissie op met spoed een wetgevingsvoorstel op basis van artikel 291, lid 3 van het VWEU in te dienen tot vaststelling van de algemene voorschriften en beginselen die van toepassing zijn op de wijze waarop de lidstaten de uitoefening van de uitvoeringsbevoegdheden door de Commissie controleren; beklemtoont dat het Parlement op zijn minst het recht op informatie over uitvoeringshandelingen moet behouden en de legaliteit ervan moet controleren, evenals het recht om resoluties aan te nemen in gevallen waarin uitvoeringshandelingen verder gaan dan de bevoegdheid die krachtens de basishandeling is verleend.
13. Calls on the Commission to present as a matter of urgency a legislative proposal based on Article 291(3) TFEU setting out the rules and general principles concerning mechanisms for control by Member States of the Commission’s exercise of implementing powers; stresses that Parliament should, at the very least, retain a right of information concerning implementing acts and control their legality, along with the right to adopt resolutions in cases where the implementing act goes beyond the authority permitted by the basic act.
