TRADUCTIONS EN CONTEXTE

Besluit ECB/2013/28 van 29 augustus 2013 inzake het procentuele aandeel van de nationale centrale banken in de verdeelsleutel voor de inschrijving op het kapitaal van de Europese Centrale Bank (ECB) (1), voorziet in de aanpassing van de sleutel voor inschrijving op het kapitaal van de Europese Centrale Bank (ECB) (hierna de „kapitaalverdeelsleutel”) overeenkomstig artikel 29.3 van de statuten van het Europees Stelsel van centrale banken en van de Europese Centrale Bank en stelt met ingang van 1 januari 2014 de aan elke nationale centrale bank (NCB) toegewezen nieuwe weging van de aangepaste kapitaalverdeelsleutel vast (hierna de „weging in de kapitaalverdeelsleutel”).
Decision ECB/2013/28 of 29 August 2013 on the national central banks’ percentage shares in the key for subscription to the European Central Bank’s capital (1) provides for the adjustment of the key for subscription to the capital of the European Central Bank (ECB) (hereinafter ‘capital key’) in accordance with Article 29.3 of the Statute of the European System of Central Banks and of the European Central Bank and establishes, with effect from 1 January 2014, new weightings assigned to each national central bank (NCB) in the adjusted capital key (hereinafter the ‘capital key weightings’).

2. „centrale bank (CB)”: de Europese Centrale Bank en de nationale centrale banken (NCB’s) van de lidstaten die de euro als munt hebben, de NCB’s van de lidstaten die de euro niet als munt hebben, (hierna: „NCB’s van buiten het eurogebied”), een centrale bank of desbetreffende bevoegde autoriteit binnen de Europese Economische Ruimte (EER) (hierna: „EER-centrale bank”) en een centrale bank of relevante bevoegde autoriteit van een land van buiten de EER (hierna: „andere centrale bank”), indien de munteenheid van een dergelijke NCB van buiten het eurogebied, EER-centrale bank of andere centrale bank wordt geacht in aanmerking te komen overeenkomstig artikel 18 van Richtsnoer ECB/2010/2;
‘central bank (CB)’ means the European Central Bank, the national central banks (NCBs) of the Member States whose currency is the euro, the NCBs of the Member States whose currency is not the euro (hereinafter ‘non-euro area NCBs’), any European Economic Area (EEA) central bank or relevant competent authority (hereinafter ‘EEA central bank’) and any central bank or relevant competent authority of a country outside the EEA (hereinafter ‘other central bank’), where the currency of such a non-euro area NCB, EEA or other central bank is considered eligible in accordance with Article 18 of Guideline ECB/2010/2;

4. De centrale banken van het Eurosysteem vergoeden de gemandateerde centrale bank volledig en prompt voor door haar aan derden betaalde schadevergoeding indien die voortvloeit uit: a) de deelnamevereisten en gunningscriteria; b) een door het selectiepanel genomen besluit op basis van de deelnamevereisten en gunningscriteria; c) de incorrecte handelwijze van het selectiepanel, tenzij het handelde overeenkomstig het schriftelijke advies van de gemandateerde centrale bank of van tevoren betreffende de aangelegenheid in kwestie geen toepasselijk schriftelijk advies van de gemandateerde centrale bank heeft ontvangen; d) een besluit of gebeurtenis buiten de macht van de gemandateerde centrale bank, waaronder ook besluiten of gebeurtenissen die de effectiviteit van de verleende licenties aantasten.
4. The Eurosystem central banks shall fully and promptly reimburse the mandated central bank for any compensation paid by it to third parties where this stems from: (a) the participation requirements and award criteria; (b) a decision made by the selection panel on the basis of the participation requirements and award criteria; (c) the incorrect conduct of the selection panel, unless it acted in line with the written advice of the mandated central bank or has not received appropriate written advice from the mandated central bank on the issue concerned in advance; (d) any decision or event beyond the control of the mandated central bank including those which may affect the effectiveness of the licences granted.

Als lidstaat met een derogatie neemt Cyprus sinds 2 mei 2005 deel aan ERM II; overwegende dat de Central Bank of Cyprus partij is bij de Overeenkomst van 16 maart 2006 tussen de Europese Centrale Bank en de nationale Centrale Banken van de lidstaten buiten het eurogebied waarin de operationele procedures zijn neergelegd voor een wisselkoersmechanisme in de derde fase van de Economische en Monetaire Unie , gewijzigd bij de Overeenkomst van 21 december 2006 (hierna gezamenlijk de „ERM II Centrale Bank Overeenkomst” te noemen).
Cyprus, as a Member State with a derogation, has participated since 2 May 2005 in ERM II; whereas the Central Bank of Cyprus is party to the Agreement of 16 March 2006 between the European Central Bank and the national central banks of the Member States outside the euro area laying down the operating procedures for an exchange rate mechanism in stage three of economic and monetary union , amended by the Agreement of 21 December 2006 (together hereinafter referred to as the ‘ERM II Central Bank Agreement’).
