The European Community notes that the Exchange of Letters between the European Community and the Former Yugoslav Republic of Macedonia, which takes the place of signature of the Agreement between the European Community and the former Yugoslav Republic of Macedonia on readmission of persons residing without authorisation, has been accomplished and that this cannot be interpreted as acceptance or recognition by the European Community in whatever form or content of a denomination other than the „former Yugoslav Republic of Macedonia”.

− We voted against this agreement because: it aims to return people to a country where, according to the UNHCR Global Appeal 2010–2011, around 212 000 people were internally displaced for more than 16 years, living in need of shelter and means to become self-sufficient, where sexual and gender-based violence is rife in all parts of society and police ill-treatment is tolerated; it also applies to those former residents of Abkhazia and South Ossetia who do not have any de facto links to Georgia; it does not include strict safeguards concerning the violation of fundamental rights and guaranteeing high standards of reception, which are poor in Georgia; it contains numerous loopholes and ambiguities which might be clarified in the Joint Readmission Committee in which Parliament regrettably has no say, which would be entirely legitimate regarding its new competences; it does not guarantee adequately the protection of personal data – data can be forwarded to ‘other bodies’ without requiring the consent of the person involved.
– Wir haben aus folgenden Gründen gegen das Abkommen gestimmt: Auf der Grundlage dieses Abkommens sollen Menschen in ein Land zurückgeschickt werden, in dem laut dem weltweiten Aufruf 2010-2011 des Hohen Flüchtlingskommissars der Vereinten Nationen in den letzten gut 16 Jahren rund 212 000 Binnenvertriebene gezählt wurden, die schutzbedürftig sind und Mittel benötigen, um nicht mehr auf fremde Hilfe angewiesen zu sein, in dem sexuelle und geschlechtsbezogene Gewalt in allen Teilen der Gesellschaft herrscht und in dem polizeiliche Misshandlungen geduldet werden. Es gilt auch für diejenigen ehemaligen Einwohner von Abchasien und Südossetien, die in Wirklichkeit keinerlei Verbindungen mit Georgien haben. Es enthält keine strengen Absicherungen in Bezug auf Verstöße gegen die Grundrechte und zur Gewährleistung hoher Aufnahmenormen; diese sind in Georgien vielmehr niedrig. Es enthält zahlreiche Schlupflöcher und Unklarheiten, die im Gemischten Rückübernahmeausschuss, geklärt werden könnten, in dem das Europäische Parlament leider kein Mitspracherecht hat, obwohl dies angesichts seiner neuen Befugnisse völlig legitim wäre. Der Schutz personenbezogener Daten wird nicht angemessen garantiert – Daten können ohne vorherige Zustimmung der betroffenen Person an „andere Stellen“ weitergeleitet werden.
