Es enthält zahlreiche Schlupflöcher und Unklarheiten, die im Gemischten Rückübernahmeausschuss, geklärt werden könnten, in dem das Europäische Parlament leider kein Mitspracherecht hat, obwohl dies angesichts seiner neuen Befugnisse völlig legitim wäre. Der Schutz personenbezogener Daten wird nicht angemessen garantiert – Daten können ohne vorherige Zustimmung der betroffenen Person an „andere Stellen“ weitergeleitet werden.
