Marlene Jennings: With regards to the National Roundtables on Corporate Social Responsibility and the Canadian Extractive Industry in Developing Countries Advisory Group Report of March 29, 2007: (a) which of the 27 recommendations have been implemented by the government; (b) which of the 27 recommendations have been partially implemented or planned; (c) what directives, if any, have been given by the Minister of Foreign Affairs to his Department regarding the study of or implementation of each of the 27 recommendations; (d) what directives, if any, have been given since the March 2007 Report, by the Department of Foreign Affairs to its embassies and missions abroad concerning government policy towards Canadian extractive industries operating abroad; (e) what follow-up consultations between the government and extractive industry representatives, civil society representatives and the academic community have been carried out since June 2007; and (f) what future consultations, if any, have been planned by the government to address the recommendations delineated in the Advisory Group Report?

(Return tabled) Question No. 206 Mr. Alex Atamanenko: With respect to Canadian Agricultural Income Stabilization (CAIS) program entitlement, the appeals process and exclusion from entitlement to other federal agricultural programs: (a) are appellants entitled to know what recommendations are made by the Western Amalgamated Appeals Sub-Committee and, if so, how is a copy of the recommendations obtained by the appellant; (b) are appellants entitled to know on what grounds the Intermediate Appeals Sub-Committee rejects recommendations of the Western Amalgamated Appeals Sub-Committee and, if so, how is a copy of the recommendations obtained by the appellant; (c) has the CAIS administration ever issued rejection letters to an appellant before or after soliciting the involvement of an appeals committee and, if so, how is a copy of the motion or other directive permitting this obtained by the appellant; (d) who is responsible for forwarding recommendations made by the Western Amalgamated Appeals Sub-Committee to the next level of appeal; (e) are there any legitimate grounds upon which the National CAIS Committee (NCC) administration is allowed to refuse an appellant the full extent of an appeal by neglecting to forward the recommendations of the Western Amalgamated Appeals Sub-Committee to the next level of appeal; (f) does the appeal process deal with appeals on a case by case basis or can the NCC administration short-circuit the appeals process based on a judgment that an appellant's complaint is just like the one that may have preceded it; (g) are there guidelines established that would give an appellant a reasonable expectation of the time it should take to address an appeal at all the various levels and, if so, what are the guidelines that govern a reasonable expectation; (h) is the appellant justified in expecting that the decisions made by appeals committees will be communicated to the appellant; (i) what are the circumstances under which it would be accepta ...

Par dérogation à toute autre disposition de la présente loi, n’est pas réputé avoir constitué une violation du droit d’auteur le fait, pour un radiodiffuseur d’avoir fixé ou reproduit entre le 16 août 1990 et l’entrée en vigueur de l’article 30.9, une œuvre, la prestation d’une œuvre ou un enregistrement sonore qu’il avait le droit de radiodiffuser à seule fin de transférer cette œuvre, cette prestation d’une œuvre ou cet enregistrement sonore en un format technique approprié à sa radiodiffusion, pourvu que le radiodiffuseur ait détruit cette reproduction immédiatement après l’entrée en vigueur de l’article 30.9 si le radiodiffuseur cesse d’avoir le droit de radiodiffuser l’œuvre ou l’objet du droit d’auteur à ce moment ou plus tôt.
Notwithstanding any other provision in this Act, there is deemed to have been no infringement of copyright where a broadcaster, on or after August 16, 1990 but before the coming into force of section 30.9, reproduced any work, performer’s performance or sound recording that it was legally entitled to broadcast solely for the purposes of transferring that work, performer’s performance or sound recording to a technical format that was appropriate for the purposes of its broadcasts, provided that all such reproductions shall be destroyed immediately after the day section 30.9 comes into force where the broadcaster on or before that day ceases to be legally entitled to broadcast the work or other subject-matter.
