2. As direct financial liability of the managing authority towards bodies implementing financial instruments or final recipients as well as its liability as regards any other debt or obligation of the financial instrument may not exceed the amount committed by the managing authority to the financial instrument under the relevant funding agreements, the bodies implementing financial instruments shall ensure that no claims can be made on the managing authority beyond the amount committed by it to the financial instrument.

When selecting a body referred to in paragraph 1, the managing authority shall take due account of the nature of the financial instrument to be implemented, the body's experience with the implementation of similar financial instruments, the expertise and experience of proposed team members, and the body's operational and financial capacity.

La Commission est habilitée à adopter des actes délégués conformément à l'article 26 du présent règlement afin de modifier les principales modalités, conditions et procédures énoncées dans la partie III de l'annexe I du présent règlement et régissant le concours de l'Union à chaque instrument financier établi conformément aux règles pour les instruments de prêt et les instruments de fonds propres énoncées dans la partie III de l'annexe I du présent règlement, conformément aux conclusions du rapport intermédiaire et de l'évaluation indépendante de la phase pilote de l'initiative Europe 2020 relative aux emprunts obligataires pour le financement de projets établie au titre de la décision no 1639/2006/CE et du règlement (CE) no 680/2007, et afin de tenir compte de l'évolution des conditions du marché en vue d'optimiser la conception et la mise en œuvre des instruments financiers relevant du présent règlement.
2. The Commission shall be empowered to adopt delegated acts in accordance with Article 26 of this Regulation to modify the main terms, conditions and procedures laid down in Part III of Annex I to this Regulation governing the Union contribution to each financial instrument established under the Debt Framework or Equity Framework laid down in Part III of Annex I to this Regulation in accordance with the results of the interim report and the independent full -scale evaluation of the pilot phase of the Europe 2020 Project Bond Initiative established under Decision No 1639/2006/EC and Regulation (EC) No 680/2007, and in order to take into account changing market conditions with a view to optimising the design and implementation of the financial instruments under this Regulation.

6. La Commission est habilitée à adopter des actes délégués en conformité avec l'article 210 en ce qui concerne l'établissement de règles détaillées en matière d'instruments financiers, y compris la sélection des entités à qui est confiée la mise en œuvre des instruments financiers, le contenu des conventions de délégation, les coûts et frais de gestion, les règles spécifiques pour les comptes fiduciaires, la mise en œuvre directe des instruments financiers et la sélection des gestionnaires, des intermédiaires financiers et des bénéficiaires finaux.
6. The Commission shall be empowered to adopt delegated acts in accordance with Article 210 concerning detailed rules on financial instruments, including the selection of entities entrusted with the implementation of financial instruments, the content of delegation agreements, management costs and fees, the specific rules for fiduciary accounts, the direct implementation of the financial instruments and the selection of managers, of financial intermediaries and of final recipients.
