15. salue l'adoption à l'unanimité, le 25 février 2011, d'une résolution sur la situation des droits de l'homme en Lybie lors de la 15 session extraordinaire, qui condamne les violations flagrantes et systématiques des droits de l'homme en Lybie en faisant observer que certaines pourraient constituer des crimes contre l'humanité; demande l'envoi d'une commission internationale indépendante pour enquêter sur toutes les violations présumées du droit international en matière de droits de l'homme commises dans le pays et soutient résolument la recommandation de suspendre la Libye du CDH; salue à cet égard la décision prise par l'Assemblée générale, le 1 mars 2011, de suspendre la Libye du droit de siéger au CDH;
15. Welcomes the adoption by consensus of a resolution on the human rights situation in Libya in the 15th Special Session on 25 February 2011 which condemns the gross and systematic human rights violations committed in Libya, pointing out that some of them may amount to crimes against humanity; calls for the dispatching of an independent international commission of inquiry to Libya to investigate all alleged violations of international human rights law in the country and strongly supports its recommendation to suspend Libya's membership of the UNHRC; welcomes in this respect the General Assembly's decision of 1 March 2011 to suspend Libya's membership of the UNHRC;

(b) the Association Committee shall, no later than six months after the entry into force of this Agreement, establish a list of at least five individuals who are not nationals of either Party, and who are willing and able to serve as arbitrators and be identified as chairperson of arbitration panels in financial services. The Association Committee shall ensure that the list always contains five individuals at any point in time. Those individuals shall have expertise or experience in financial services law or practice, which may include the regulation of financial institutions, be independent, serve in their individual capacities and not be affiliated with, nor take instructions from, any Party or organisation and shall comply with the Code of Conduct set out in Annex XVI. Such list may be amended every three years.

Those individuals shall have specialised knowledge or experience in law, international trade or other matters relating to this Part of the Agreement or in the resolution of disputes deriving from international trade agreements, be independent, serve in their individual capacities and not be affiliated with, nor take instructions from, any Party or organisation and shall comply with the Code of Conduct set out in Annex XVI. Supports the replacement of the UN Commission on Human Rights (UNCHR) with a reduced standing Human Rights Council (HRC) directly elected by the General Assembly – which, when electing members to serve in that body, should choose countries that respect human rights most scrupulously – with a strengthened majority, which will give it greater democratic legitimacy and political authority; supports the incorporation into the working methods of the UNCHR of a "peer review" mechanism which would allow for each country to be subject, on a regular basis, to a human rights assessment; supports the idea of linking accession to the HRC to the obligation for a member state to issue a standing invitation allowing for the implementation of the UN mechanisms and procedures; considers that it is of the utmost importance to reinforce the role of independent NGOs within the HRC and that their participation requires a reform of the Committee of NGOs;
