Il en résulte, de l'avis du rapporteur, qu'il convient de se féliciter de l'affirmation d'une compétence pénale de la Communauté européenne, éventuelle et partielle, du moment que celle-ci s'accompagne d'une claire détermination de ses présupposés et de sa portée; que la Commission fait bien de retirer les propositions pendantes et de réviser la législation déjà adoptée lorsque ces textes doivent être considérés comme entachés d'illégalité à la lumière de l'arrêt cité; qu'en aucun cas, elle ne peut préjuger de la participation effective du Parlement européen au processus décisionnel impulsé en la matière.

a potential, albeit partial, competence in relation to criminal matters provided the prerequisite conditions for, and the scope of, any such competence is clearly established; that the Commission is right to withdraw pending proposals and to resubmit legislation that has already been adopted, if such legislation must be regarded as unlawful in the light of the judgment in question; and that, in any event, there can be no question of excluding the European Parliament from participating actively in the relevant de
