For organic wine exported from the United States to the Union, the United States authorities have agreed to apply and certify compliance with the rules for organic wine laid down in accordance with Commission Regulation (EC) No 889/2008 of 5 September 2008 laying down detailed rules for the implementation of Council Regulation (EC) No 834/2007 on organic production and labelling of organic products with regard to organic production, labelling and control (4) as amended by Commission Implementing Regulation (EU) No 203/2012 (5) as from 1 August 2012 and until such time as a joint working group has concluded its examination of the equivalence of organic wine making rules.

What matters now, though, is that our rules on labelling should be enforced, and we also see it as significant that the USA is ready and willing to resolve all bilateral issues through consultation rather than through the WTO’s dispute settlement procedures, but what is surely most important to us Europeans is that geographical indications of origin should enjoy in the United States the protection that they deserve, in return for which we – for the time being – are prepared to accept the Americans’ winemaking practices.

The Commission must, therefore, make more vigorous endeavours to achieve a genuine international agreement with the United States as soon as possible which regulates the matter on the basis of fundamental principles: respect for the principle of reciprocity, on the basis of which, if the Union gives US citizens the same rights as its own citizens, then the United States must do the same for European citizens; respect for the principle of proportionality; respect for the principle of informed consent and the right of the person concerned to appeal to an independent authority or judge.
