The U.S. Department of Commerce should also conduct regular searches for companies making false claims about their participation in the Privacy Shield. More awareness-raising for EU individuals about how to exercise their rights under the Privacy Shield, notably on how to lodge complaints. Closer cooperation between privacy enforcers i.e. the U.S. Department of Commerce, the Federal Trade Commission, and the EU Data Protection Authorities (DPAs), notably to develop guidance for companies and enforcers. Enshrining the protection for non-Americans offered by Presidential Policy Directive 28 (PPD-28), as part of the ongoing debate in the U.S. on the reauthorisation and reform of Section 702 of the Foreign Intelligence Surveillance Act (FISA). To appoint as soon as possible a permanent Privacy Shield Ombudsperson, as well as ensuring the empty posts are filled on the Privacy and Civil Liberties Oversight Board (PCLOB).

On 26 February 2009, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which funds of two private equity groups (a) Irving Place Capital Partners III (Cayman), L.P (‘IPC Fund’, Cayman Islands) and (b) OCM Principal Opportunities Fund IV (USA), L.P. and OCM European Principal Opportunities Fund II (USA), L.P (‘Oaktree Funds’, USA) will acquire joint indirect control within the meaning of Article 3(1)(b) of the Council Regulation substantially all the US operating assets of Chesapeake Corporation (USA) and its US subsidiaries and Chesapeake's shares in Chesapeake Asia Pacific Limited and Chesapeake UK Holdings Limited (together ‘Chesapeake’) by way of purchase of shares in two newly created corporate vehicles constituting a joint venture.

It was in fact planned that there should be, at the beginning of February a high-level joint démarche involving representatives of the European Union and of the United States, namely the Council’s Director-General for external relations and political-military affairs, Robert Cooper, and the U.S. Assistant Secretary of State for Europe, Dan Fried, but the authorities in Belarus refused to issue these two dignitaries with the visas that would enable them to visit the country both at the same time, and that has made such a démarche impossible.
