Étant donné que le système espagnol prévoit, à l’article 43 de la LEC (1), cet effet suspensif ou préjudiciel au regard de l’action individuelle engagée parallèlement par le consommateur jusqu’au prononcé d’un jugement définitif dans la procédure collective, ce dernier étant lié par ce qui est décidé dans ce cadre sans avoir pu défendre utilement son droit ni présenter des éléments de preuve avec tous les moyens à sa disposition:
Given that the Spanish system provides in Article 43 of the LEC (1) that, where an individual action is brought concurrently by a consumer, the effect is that that action must be stayed and treated as a preliminary issue pending final judgment in collective proceedings, and that the consumer is bound by the decision in those proceedings without having had the opportunity to put forward the appropriate pleas or adduce evidence with full equality of arms:
