On 25 November 2014, the Agency's Committee for Socio-Economic Analysis (SEAC) adopted by consensus an opinion indicating that the proposed amendment of the existing restriction is proportionate as it would not impose additional compliance costs on manufacturers, importers or consumers, but would improve the enforceability of the restriction.

2. For the purposes of this Regulation, the definitions of ‘making available on the market’, ‘placing on the market’, ‘manufacturer’, ‘importer’, ‘distributor’, ‘economic operators’, ‘harmonised standard’, ‘market surveillance’ and ‘market surveillance authority’ set out in Article 2 of Regulation (EC) No 765/2008 shall apply.

7. Les États membres veillent à ce que les fabricants de produits du tabac fournissent à tous les opérateurs économiques concernés par le commerce de ces produits, du fabricant au dernier opérateur économique avant le premier détaillant, y compris les importateurs, entrepôts et sociétés de transport, l’équipement nécessaire pour enregistrer les produits du tabac achetés, vendus, stockés, transportés ou soumis à toute autre manipulation.
7. Member States shall ensure that the manufacturers of tobacco products provide all economic operators involved in the trade of tobacco products, from the manufacturer to the last economic operator before the first retail outlet, including importers, warehouses and transporting companies, with the equipment that is necessary for the recording of the tobacco products purchased, sold, stored, transported or otherwise handled.

(9) Afin de garantir une cohérence, pour les obligations spécifiques des opérateurs économiques, entre le présent règlement et la législation sectorielle d’harmonisation de l’Union, il convient que les dispositions applicables aux fabricants, mandataires, importateurs et distributeurs se fondent sur les dispositions de référence figurant dans la décision n° 768/2008/CE du Parlement européen et du Conseil du 9 juillet 2008 relative à un cadre commun pour la commercialisation des produits[16].
(9) In order to ensure consistency between this Regulation and sector-specific Union harmonisation legislation with regard to specific obligations of economic operators, the provisions concerning manufacturers, authorised representatives, importers and distributors should be based on the reference provisions included in Decision No 768/2008/EC of the European Parliament and of the Council of 9 July 2008 on a common framework for the marketing of products[16].
