Le règlement (CE) n° 338/97 du Conseil relatif à la protection des espèces de faune et de flore sauvages par le contrôle de leur commerce[2], qui met en œuvre les dispositions de la convention sur le commerce international des espèces de faune et de flore sauvages menacées d'extinction (CITES) dans la Communauté européenne, interdit l'introduction de cétacés dans la Communauté à des fins principalement commerciales[3]. Ce niveau élevé de protection est encore renforcé par la stratégie communautaire pour la conservation du milieu marin[4] et par la proposition de directive concernant une stratégie pour le milieu marin[5], qui devrait renforcer la protection des baleines dans la Communauté en contribuant à l’objectif global de bon état écologique de nos mers et océans.
3. Council Regulation 338/97/EC on the protection of species of wild fauna and flora by regulating trade therein,[2] implementing the provisions of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) in the EC, bans the introduction of cetaceans into the Community for primarily commercial purposes.[3] This high level of protection is further reinforced by the EC Marine Strategy[4] and the proposed Marine Directive[5] that is expected to strengthen whales' protection in the EC by fostering the overall objective of good environmental status of the EU oceans and seas.
