Eu égard aux évolutions épidémiologiques et ornithologiques actuelles en ce qui concerne cette maladie, il convient de prendre des dispositions pour réexaminer ces risques de façon régulière et continue, en vue d’adapter les zones considérées comme particulièrement menacées par la propagation de la maladie et les mesures prises dans ces zones.
In the light of current epidemiological and ornithological developments with regard to that disease, provision should be made to review such risks on a regular and ongoing basis with a view to adjusting the areas identified as particularly at risk for the spread of the disease and the measures taken in those areas.

The purpose of Council Directive 79/409 is the protection, balanced management and rational exploitation of wild birds in the territory of the Member States and migration is a cross-border phenomenon. Furthermore, the EU’s policy must take account of the changing habits of wild birds, in relation not only to Community territory, but the other areas where they are found. In view of the climatic and cultural differences between the various Member States and the different bird species found there, the Member States should be able to use their discretion in setting the dates of the hunting season (between 15 July and 28 February) whilst respecting precise criteria. Is the Commission willing to amend the directive, in particular Article 7(4) thereof, and hence prevent divergence in its application and a consequent legal dispute at Community and national level?
