Faut-il interpréter les articles 26, paragraphe 2, 35 et 56 TFUE en ce sens qu’est incompatible avec ces dispositions une règlementation nationale comme celle des articles 24/C et 24/D de l’adózás rendjéről szóló 2003. évi XCIII. törvény (loi XCIII de 2003 portant organisation de la fiscalité) sur la base de laquelle une société de droit hongrois qui exerce une activité commerciale dans d’autres États membres de l’Union européenne ne peut employer comme dirigeant de la société un ressortissant hongrois pour la seule raison qu’il a exercé auparavant la même fonction de direction dans une autre entreprise hongroise exerçant son activité sur le marché domestique et que cette autre société a accumulé un passif fiscal, alors que l’accumulation de ce passif fiscal n’était pas imputable au citoyen hongrois concerné en tant qu’ancien dirigeant de ladite société?
May Articles 26(2) TFEU, 35 TFEU and 56 TFEU be interpreted as precluding rules of a Member State such as those in Paragraphs 24/C and 24/D of the General Tax Law where, under such rules, a Hungarian company which carries on business partly in other Member States of the European Union may not appoint as a senior executive a Hungarian citizen who has previously held a senior executive position in another Hungarian company which carries on business in the internal market, solely on the ground that other Hungarian company has accumulated a tax debt of a certain level, when the accumulation of that debt is not attributable to that Hungarian citizen in his capacity as a former senior executive?
