In the gas regional initiatives progress was made on the following issues: a day-ahead gas price index was established for the Central European Gas Hub (CEGH); concrete plans were developed to increase interconnection at the French and Spanish border; the work in the North West region focused on balancing, gas quality, hubs and transparency.

D’après l’évaluation, les mesures systématiques mises en place au niveau national sont encore trop rares, bien qu’il existe quelques exemples utiles, comme les conseillers pour l’emploi des Roms créés sous l’égide du ministère de l’emploi en Finlande, la réaffectation de ressources pour le programme espagnol Acceder ou les projets pilotes mis en œuvre dans certaines municipalités de République tchèque en vue d’intégrer les aspects sociaux dans les procédures de marchés publics.
The assessment reveals that there are still too few systematic measures put in place at national level, although there are some good examples: the Roma job counsellors under the Ministry of Employment in Finland, the reallocation of resources for the Spanish Acceder program, or pilot projects in some municipalities in the Czech Republic introducing social considerations in public procurement.

According to the Spanish authorities (29), the Spanish tax system provides for different tax schemes, as in the case of shareholding acquisitions in foreign companies compared with acquisitions in Spanish companies (impossible to undertake merger operations, risk assumption, etc.), in order to achieve the tax neutrality sought by the Spanish domestic legislation and Community law itself and also in order to ensure that the Spanish tax system is consistent and efficient.

However, the Spanish authorities have demonstrated adequately that this would not have been a viable alternative: the seizure of tangible assets was of no real value, given the preferential status of a mortgage previously registered in favour of the public entity RUMASA, and it is reasonable to agree with the Spanish authorities’ view that any seizure of the intangible assets would have been precarious, given the necessary dependence under Spanish law on potential buyers for whom those assets, once separated from the name of the company, would be of very limited if any value.
