This has offered to the nine EU Member States[22], who are members of the Organisation for Cooperation between Railways (OSJD), the necessary respite to ensure that the future annex of the OSJD Convention[23] will provide similar standards of protection for international rail passengers.

(1) Dans le cadre de la politique commune des transports, il importe de sauvegarder les droits des voyageurs ferroviaires internationaux voyageant entre les États membres et d'améliorer la qualité et l'efficacité des services ferroviaires internationaux de voyageurs entre les États membres afin d'aider à accroître la part du transport ferroviaire par rapport aux autres modes de transport.
(1) In the framework of the common transport policy, it is important to safeguard users' rights for international rail passengers travelling between the Member States and to improve the quality and effectiveness of international rail passenger services between the Member States in order to help the increase of the share of rail transport in relation to other modes of transport.

(6) Le renforcement des droits des voyageurs ferroviaires internationaux devrait reposer sur le système de droit international existant à ce sujet qui figure à l'appendice A - règles uniformes concernant le contrat de transport international ferroviaire des voyageurs et des bagages (CIV) de la convention relative aux transports internationaux ferroviaires (COTIF) du 9 mai 1980, telle que modifiée par le protocole portant modification de la COTIF du 3 juin 1999 (protocole de 1999).
(6) Strengthening of the rights of international rail passengers should build on the existing system of international law on this subject contained in Appendix A – Uniform rules concerning the Contract for International Carriage of Passengers and Luggage by Rail (CIV) to the Convention concerning International Carriage by Rail (COTIF) of 9 May 1980, as modified by the Protocol for the modification of the Convention concerning International Carriage by Rail of 3 June 1999 (1999 Protocol).

Il est, en revanche, souhaitable d'étendre le champ d'application, afin de protéger non seulement les voyageurs ferroviaires internationaux, mais aussi les voyageurs ferroviaires nationaux.

(7) In order to ensure that the international rail passenger will benefit from the rules laid down in this Regulation, the railway undertakings offering rail passenger services should cooperate.

L’adoption du règlement européen sur les droits et obligations des voyageurs ferroviaires internationaux aura pour conséquence que ces droits seront réglementés pour le transport aérien et ferroviaire, mais qu’aucune réglementation ne s’appliquera aux transports internationaux et de longue distance de voyageurs par autobus. Dans la pratique, les passagers bénéficieront d’un meilleur traitement, surtout en cas d’incident malheureux au cours d’un transport aérien ou ferroviaire, mais de coûts inférieurs an cas de transport par autobus.
The adoption of a European regulation on the rights and duties of international rail passengers will mean that such rights will be regulated in respect of air and rail transport, but not of international and long-distance coach transport, so concern for the passenger will ensure better treatment, particularly in the event of accidents on rail and air transport systems, but also at the same time will ensure lower costs for coach transport.
