A new phase now begins for the period 2005-2010, with a very different focus: consolidation of existing legislation, with few new initiatives; ensuring the effective transposition of European rules into national regulation and more rigorous enforcement by supervisory authorities; continuous ex-post evaluation whereby the Commission will monitor carefully the application of these rules in practice – and their impact on the European financial sector. Member States, regulators and market participants must play their role. If needed, the Commission will not hesitate to propose to modify or even repeal measures that are not delivering the intended benefits. This approach is essential to ensure that the hard-won European regulatory framework will function optimally – for the benefit of market participants, more than 20 million European businesses and 450 million citizens, and thus for the European economy as a whole.

Calls on the Commission, in view of the serious and persistent problems which arise in the implementation of Regulation (EC) No 1924/2006 on nutrition and health claims made on foods, including problems involving distortion of competition, to review the scientific basis for this regulation and, if appropriate, to eliminate the concept of nutrient profiles or to repeal the regulation in its entirety; considers that the aims of this regulation, such as ensuring that the information provided about foods is true and that specific indications are given about fat, sugar and salt content, have now been achieved by Regulation (EU) No 1169/2011 on the provision of food information to consumers;

On pourrait faire valoir le fait que cette décision a été rendue automatiquement caduque lors de son remplacement par un règlement de la Commission (voir l'article 20 de la directive 2004/68/CE précitée) mais, par souci de clarté et de transparence, non seulement vis-à-vis des États membres et de ceux qui ont la charge de mettre en œuvre la législation, mais aussi pour les pays tiers qui importent les produits concernés dans l'Union européenne, la Commission a opté pour une approche stricte consistant à proposer une abrogation par codécision.
One could argue that this Decision lapses automatically when it has been replaced by a Commission Regulation (see Article 20 of Directive 2004/68 above) but for the sake of clarity and transparency not only for the Member States and that in change of the implementation of the legislation but also for the third countries importing the products concerned into the EU the Commission opted for a strict approach proposing a repeal by codecision.
