A member that has notified the Fund that it intends to avail itself of transitional arrangements under this provision may, notwithstanding the provisions of any other articles of this Agreement, maintain and adapt to changing circumstances the restrictions on payments and transfers for current international transactions that were in effect on the date on which it became a member.

4. In addition to providing the information set out in Article 6 of this Directive, the employer shall, pursuant to Article 15 of Directive 89/391/EEC, adapt the measures referred to in this Article to the requirements of workers at particular risk and, where applicable, to individual risks assessments, in particular in respect of workers who have declared the use of active or passive implanted medical devices, such as cardiac pacemakers, or the use of medical devices worn on the body, such as insulin pumps, or in respect of pregnant workers who have informed their employer of their condition.

123. La procédure visée au présent article peut également être appliquée dans le cas d’une personne à charge déposant une demande après avoir, conformément à l’article 6, paragraphe 34, du présent article, consenti à ce que son cas soit traité dans le cadre d’une demande faite en son nom. Dans une telle hypothèse, l’examen préliminaire visé au paragraphe 3 du présent article consistera à déterminer s’il existe des éléments de fait se rapportant à la situation de la personne à charge de nature à justifier une demande distincte.
123. The procedure referred to in this Article may also be applicable in the case of a dependant who lodges an application after he/she has, in accordance with Article 6(3)(4), consented to have his/her case be part of an application made on his/her behalf. In this case the preliminary examination referred to in paragraph 3 of this Article will consist of examining whether there are facts relating to the dependant’s situation which justify a separate application.

(10) Where applications affecting the same Canada lands are pending at the same time under subsection (2) and under section 116 or 117, the application under subsection (2) shall be disposed of first and, if any delay arising from the operation of this subsection adversely affects the right of any person to apply or maintain an application for a special renewal permit or a lease under section 54, such right shall be deemed not to be so affected.
