En ce qui concerne la seconde branche du premier moyen, tirée de la violation du droit d’être entendu visé à l’article 73, seconde phrase, du règlement nº 40/94, le Tribunal a relevé, aux points 44 des arrêts attaqués, que, selon la première chambre de recours de l’OHMI, l’élément essentiel permettant d’identifier l’origine du produit pour le consommateur concerné est l’étiquette apposée sur la bouteille de vin mousseux plutôt que la forme de la bouteille ou son aspect extérieur.
As regards the second part of the first plea, alleging infringement of the right to be heard referred to in the second sentence of Article 73 of Regulation No 40/94, the General Court noted, at paragraphs 44 of the judgments under appeal, that according to the First Board of Appeal the essential element allowing the relevant consumer to identify the origin of the product is the label affixed to the bottle of sparkling wine rather than the shape of the bottle or its appearance.
