(2) (a) Where, prior to the entry into force of this Agreement, a worker other than a worker referred to in Article VI, who is subject to the legislation of one Party and who is employed by an employer having his place of business in the territory of that Party has been sent by that employer to work in the territory of the other Party, he shall after the entry into force of this Agreement be entitled to choose within three months of such entry into force that the legislation of one Party or the other shall apply to him in respect of such employement; and if he chooses to be covered under the legislation of the first Party, then the legislation of that Party shall apply to him for a period of up to 24 months; and if he chooses to be covered under the legislation of the second Party, then the legislation of that Party shall apply to him; and in either case his choice shall take effect from the day on which he gives notice to the appropriate competent authority.

Judgments given before the date of application of this Regulation but after the date of entry into force of Regulation (EC) No 1347/2000 in proceedings instituted before the date of entry into force of Regulation (EC) No 1347/2000 shall be recognised and enforced in accordance with the provisions of Chapter III of this Regulation provided they relate to divorce, legal separation or marriage annulment or parental responsibility for the children of both spouses on the occasion of these matrimonial proceedings and that jurisdiction was founded on rules which accorded with those provided for either in Chapter II of this Regulation or in Regulation (EC) No 1347/2000 or in a convention concluded between the Member State of origin and the Member State addressed which was in force when the proceedings were instituted.

111. Il est toutefois prévu qu'une décision peut être exécutée conformément aux dispositions, avantageuses, de la convention même si l'action a été intentée avant son entrée en vigueur pour autant: a) que la convention soit entrée en vigueur entre l'État d'origine et l'État requis et b) que les règles de compétence appliquées par la juridiction d'origine aient été conformes aux dispositions du titre II ou aux dispositions d'une convention qui était en vigueur entre les deux États lorsque l'action a été intentée.
111. There is, however, provision for the possibility of allowing a judgment to benefit from the system in the Convention, even if the action was brought before its entry into force, if the following requirements are met: (a) the Convention is in force between the Member State of origin and the Member State addressed; (b) jurisdiction was founded on rules which accorded with those provided for either in Title II of this Convention or in a convention concluded between the Member State of origin and the Member State addressed which was in force when the proceedings were instituted.
