Avant de placer sur le marché un dispositif médical de diagnostic in vitro, les fabricants veillent à contracter une assurance de responsabilité civile appropriée couvrant le risque d'insolvabilité et tout dommage pouvant être attribué directement à un vice de fabrication du dispositif médical que des patients ou des utilisateurs pourraient subir, assortie d'un degré de couverture proportionné au risque potentiel que comporte le dispositif médical de diagnostic in vitro fabriqué, et conformément à la directive 85/374/CEE.
10a. Before placing an in vitro diagnostic medical device on the market, manufacturers shall ensure they are covered by appropriate liability insurance covering the risk of insolvency and any damage to patients or users that can be directly attributed to a manufacturing defect of the same medical device, with a level of coverage proportionate to the potential risk associated with the in vitro diagnostic medical device produced, and in accordance with Directive 85/374/EEC.
