Or, ainsi qu’il a été jugé aux points 43 et 44 de l’ordonnance attaquée, la condition relative à la signature de la requête par un avocat habilité à exercer devant une juridiction d’un État membre étant une condition de forme substantielle prévue par le statut de la Cour de justice et publiée, notamment, dans le Recueil des traités de l’Union européenne ainsi qu’au Journal officiel de l’Union européenne, les requérantes ont été ainsi mises en mesure de connaître l’existence de ladite condition et ne peuvent utilement soutenir que le comportement de la Commission a provoqué une confusion admissible dans leur esprit sur les modalités de leur représentation en justice devant le juge communautaire.
37 However, as was determined in paragraphs 43 and 44 of the order under appeal, since the condition that the application must be signed by a lawyer authorised to practise before a court of a Member State is an essential procedural condition laid down by the Statute of the Court of Justice and published, inter alia, in the Selected Instruments taken from the Treaties of the European Union and in the OfficialJournal of the European Union, the appellants were thus put in a position to be aware of the existence of that condition and cannot reasonably maintain that the conduct of the Commission caused a pardonable confusion in their minds as to the rules relating to their legal representation before the Community courts.
