Trois options sont proposées : une option "réglementaire" et unitaire qui viserait à résoudre les deux types de problèmes par l'adoption d'un régime juridique communautaire applicable à la garantie commerciale; une option "volontariste" qui consisterait à résoudre les deux types de problèmes par le biais de systèmes volontaires; une option "mixte" qui consisterait à résoudre le premier type de problèmes par l'adoption d'un régime juridique communautaire, le cas échéant complété par des règles volontaires issues de l'auto-réglementation, et le deuxième par un système entièrement volontaire - la création d'une "garantie européenne" - auquel les entreprises seraient libres d'adhérer.
There are three possible solutions: a "regulatory" and unitary option designed to resolve the two types of problem by adopting a mandatory Community legal scheme applicable to the commercial guarantee; a voluntarist option which would resolve both problems via optional schemes; a "mixed" option which would involve resolving the first type of problem by adopting a mandatory Community legal scheme, where relevant supplemented by voluntary rules on the basis of self-regulation, and the second by an entirely voluntary scheme - the creation of a "European guarantee" - to which undertakings would be free to subscribe.
