The Commission’s decision also concerned two other infringements implemented by the Trade Association of Italian Raw Tobacco Processors (Associazione professionale trasformatori tabacchi italiani: APTI) and the Italian Tobacco Union (Unione italiana tabacco, Unitab) in the setting of the prices to be negotiated on behalf of their respective members.

En 2005 , la Commission a infligé des amendes d'un montant total de 56 millions d’euros à plusieurs entreprises pour leur participation, entre 1995 et 2002, à une entente horizontale mise en œuvre sur le marché italien du tabac brut, qui avait pour objet, notamment, la collusion sur les prix à payer aux producteurs de tabac et aux intermédiaires, ainsi que la répartition des fournisseurs. In 2005 , the Commission imposed fines totalling €56 million on several undertakings for their participation in a horizontal cartel on the Italian raw tobacco market between 1995 and 2002. The object of the cartel was, inter alia, collusion on the prices to be paid to tobacco producers and to intermediaries, as well as the allocation of suppliers , The Commission’s decision also concerns two other infringements implemented by the Associazione professionale trasformatori tabacchi italiani (APTI, the Professional Association of Italian Raw Tobacco Processors) and the Unione italiana tabacco (Unitab, the Italian Tobacco Union) in relation to the fixing of prices to be negotiated on behalf of their respective members.

Rejects the interpretation of the Turkish Government that such measures refer to the free movement of services and thus do not fall within the scope of the Ankara Agreement; recalls in this context that the case law established by the European Court of Justice relating to free circulation of goods within the EU (Società Italiana per l’Oleodotto Transalpino (SIOT) v Ministero delle finanze, Ministero della marina mercantile, Circoscrizione doganale di Trieste and Ente autonomo del porto di Trieste, Judgment of the European Court of Justice of 16 March 1983, Case 266/81, European Court reports 1983 p. 731) applies equally to trade between Turkey and the European Union, including Cyprus;
