Le traité de Lisbonne prévoit l'introduction de l'initiative citoyenne européenne. Il introduit ainsi dans le droit constitutionnel européen une innovation significative, qui avait à l'origine été élaborée dans le cadre de la convention européenne en étroite collaboration avec les organisations non gouvernementales et qui n'a été incluse dans le projet constitutionnel de la convention qu'après de longues négociations.
In providing for the introduction of the European Citizens' Initiative (ECI), the Lisbon Treaty contains a significant innovation in the area of European constitutional law, one which had originally been worked out in the European Convention, in close cooperation with non-governmental organisations, and which was only included in the draft Constitution prepared by that Convention after a lengthy struggle.

2. Tout médicament ne figurant pas à l'annexe I peut faire l'objet d'une autorisation de mise sur le marché délivrée par la Communauté conformément aux dispositions du présent règlement, à condition que le demandeur démontre que ce médicament présente une innovation significative sur le plan thérapeutique, scientifique ou technique ou que la délivrance d'une autorisation conformément au présent règlement présente, pour les patients ou du point de vue de la santé animale, un intérêt au niveau communautaire.
2. Any medicinal product not appearing in Annex I may be granted a marketing authorisation by the Community in accordance with the provisions of this Regulation, provided that the applicant shows that the medicinal product is a significant therapeutic, scientific or technical innovation or that the granting of authorisation in accordance with this Regulation is of interest to patients or to animal health at Community level.
