Par ordonnance du 29 octobre 2015, la Cour de justice de l’Union européenne (première chambre) a jugé qu’elle est manifestement incompétente pour se prononcer sur le recours en annulation introduit par Monsieur Udo Voigt le 31 juillet 2015 et a renvoyé l’affaire au Tribunal de l’Union européenne.
By Order of 29 October 2015, the Court of Justice of the European Union (First Chamber) held that it clearly does not have jurisdiction to decide on the action for annulment brought by Mr Udo Voigt on 31 July 2015 and referred the case to the General Court of the European Union.

G. considérant qu'Udo Voigt soutient que la durée de la procédure, lancée en 2006, démontre une volonté de nuire à son travail parlementaire; que la présente demande de levée de l'immunité s'explique cependant par d'autres procédures, déclenchées suite à un recours introduit par Udo Voigt et que le principe de nemo auditur propriam turpitudinem allegans s'applique par conséquent à cette objection;
G. whereas Udo Voigt claims that the length of the proceedings, which were initiated in 2006, demonstrates a desire to obstruct his parliamentary work; whereas, however, the present request for waiver of immunity is explained by further proceedings which were initiated by a remedy introduced by Udo Voigt himself, and the principle of nemo auditur propriam turpitudinem allegans therefore applies to this objection;
