La partie requérante fait valoir premièrement, que la taxe sur les communications électroniques serait contraire à l’article 110 TFUE, deuxièmement, que les taxes litigieuses constitueraient une restriction à la libre prestation de services et à la liberté d’établissement en ce que l’accumulation des taxes spécifiques sur les secteurs de la radiodiffusion et de la télécommunication limite largement la possibilité pour les opérateurs de radiodiffusion et de télécommunication d’exercer leurs activités économiques en France et, troisièmement, que la mesure litigieuse serait contraire à la directive 2002/20 du 7 mars 2002 relative à l’autorisation de réseaux et de services de communications électroniques dans la mesure où elle met une taxe à la charge des opérateurs télécoms qui ne respectent pas les conditions prévues par la directive.
The applicant argues, first, that the tax on electronic communications is contrary to Article 110 TFEU; second, that the disputed taxes constitute a restriction on the freedom to provide services and the freedom of establishment in that the accumulation of specific taxes on the broadcasting and telecommunications sectors largely limits the possibility for broadcasting and telecommunications operators to carry on their economic activities in France; and, third, that the disputed measure is contrary to Directive 2002/20 of 7 March 2002 on the authorisation of electronic communications networks and services in so far as it places a tax on telecoms operators who do not comply with the conditions laid down by the directive.

The European Commission has cleared under the EU Merger Regulation the proposed joint acquisition of Q-Telecommunications (“Q-Telecom”), the smallest mobile telephony operator in Greece, by TPG Advisors IV (“TPG IV”) and Apax Partners Holdings (“Apax”), private investors who already jointly control the third largest Greek mobile telephony supplier, TIM Hellas.
