In order to comply with the information requirement under this Article, the carrier and performing carrier shall provide passengers with at least the information contained in a summary of the provisions of this Regulation prepared by the Commission and made public.

13. Validité de l'appel d'offres: Le présent appel d'offres n'est valable que pour autant qu'aucun transporteur de l'EEE (par transporteur de l'EEE, on entend un transporteur aérien de la Communauté titulaire d'une licence d'exploitation valable délivrée par un pays de l'AELE partie à l'accord EEE, conformément à l'acte visé au point 66b de l'annexe XIII de l'accord EEE [règlement (CEE) no 2407/92 du Conseil concernant les licences des transporteurs aériens]) n'informe le Ministère des communications, quatre semaines au moins avant l'entrée en vigueur du contrat, de son intention de commencer à exploiter des vols réguliers, conformément aux obligations de service public imposées aux liaisons aériennes, sans demander ni soutien financier ni protection du marché.
13. Validity of the invitation to tender: This invitation to tender shall be valid only to the extent that no EEA carrier (EEA carrier means a Community air carrier or an air carrier with a valid operating license granted by an EFTA State, party to the EEA Agreement, in accordance with the Act referred to in point 66b in Annex XIII of the EEA Agreement (Council Regulation (EEC) No 2407/92 on licensing of air carriers)) informs the Ministry of Communications, 4 weeks or more before the intended entry of force of the contract, that it will commence scheduled flights according to the public service obligations on any of the air routes without requiring any financial support or market protection.

Si aucun transporteur aérien n'a informé le ministère des communications islandais qu'il avait commencé ou était sur le point de commencer à exploiter des services aériens réguliers sur lesdites liaisons 4 semaines avant l'entrée en vigueur prévue du contrat, qui prend effet le 1.1.2007, conformément à l'obligation de service public imposée sur les liaisons susmentionnées, et sans demander de compensation financière ni de protection du marché, l'Islande a décidé, dans le cadre de la procédure prévue à l'article 4, paragraphe 1, lettre d), du même règlement, de limiter l'accès à la liaison à un seul transporteur aérien et de concéder, après appel d'offres, le droit d'exploiter ces liaisons pour 3 ans à compter du 1.1.2007.
If no air carrier has informed the Ministry of Communications in Iceland that it has commenced, or is about to commence, scheduled air services 4 weeks before the intended coming into force of the contract on the said routes, effective as of 1.1.2007, in conformity with the public service obligation imposed on the routes mentioned above, without requesting financial compensation or market protection, Iceland has decided, under the procedure provided for by Article 4(1)(d) of the same Regulation, to limit access to only 1 air carrier on each route and following an invitation to tender, to grant the right to operate the routes for 3 years with effect from 1.1.2007.

(4) Dans la Communauté, il existe des règles strictes concernant l'octroi d'aides d'État aux transporteurs aériens et il importe de mettre en place un instrument protégeant les transporteurs communautaires afin qu'ils ne souffrent pas d'un handicap concurrentiel et ne subissent pas un préjudice par rapport aux transporteurs aériens non communautaires qui sont subventionnés ou qui bénéficient d'autres avantages accordés par les pouvoirs publics.
(4) Within the Community there are strict rules regarding the granting of State aid to air carriers, and for Community air carriers not to be placed at a competitive disadvantage and suffer injury there is a need for an instrument to offer protection against non-Community air carriers who are subsidised or receive other benefits from governments.

Conformément à l'article 4, paragraphe 1, point a, du règlement concernant l'accès des transporteurs aériens communautaires aux liaisons aériennes intracommunautaires [55], un État membre peut, après avoir consulté les autres États concernés et après en avoir informé la Commission et les transporteurs aériens qui exploitent la liaison, imposer des obligations de service public sur des services aériens réguliers vers un aéroport desservant une zone périphérique ou de développement située sur son territoire ou sur une liaison à faible trafic à destination d'un aéroport régional situé sur son territoire, si ces liaisons sont considérées comme vitales pour le développement économique de la région dans laquelle est situé l'aéroport, dans la mesure nécessaire pour assurer sur cette liaison une prestation de service adéquate répondant à des normes fixes en matière de continuité, de régularité, de capacité et de prix, normes auxquelles le transporteur ne satisferait pas s'il ne devait considérer que son seul intérêt commercial.
According to Article 4(1)(a) of the Regulation on access for Community air carriers to intra-Community air routes [55], a Member State, following consultations with the other Member States concerned and after having informed the Commission and air carriers operating on the route, may impose a public service obligation in respect of scheduled air services to an airport serving a peripheral or development region in its territory or on a thin route to any regional airport in its territory, any such route being considered vital for the economic development of the region in which the airport is located, to the extent necessary to ensure on that route the adequate provision of scheduled air services satisfying fixed standards of continuity, regularity, capacity and pricing, which standards air carriers would not assume if they were solely considering their commercial interest.
