1. Nonobstant d’autres dispositions, lorsqu’un bénéficiaire ou un demandeur de prestations, ou un membre de sa famille, séjourne ou réside sur le territoire d’un État membre autre que celui où se trouve l’institution débitrice, le contrôle médical est effectué, à la demande de cette institution, par l’institution du lieu de séjour ou de résidence du bénéficiaire conformément aux procédures prévues par la législation que cette institution applique.
1. Without prejudice to other provisions, where a recipient or a claimant of benefits, or a member of his family, is staying or residing within the territory of a Member State other than that in which the debtor institution is located, the medical examination shall be carried out, at the request of that institution, by the institution of the beneficiary’s place of stay or residence in accordance with the procedures laid down by the legislation applied by that institution.

Where a recipient or a claimant of benefits, or a member of his family, is staying or residing in the territory of a Member State other than that in which the debtor institution is located, the administrative check shall, at the request of the debtor institution, be performed by the institution of the beneficiary’s place of stay or residence.

Sans préjudice des dispositions des articles X et XXI de la présente Convention, toute prestation qui n’a pas été liquidée ou qui a été suspendue à cause de la nationalité de l’intéressé ou en raison de sa résidence sur le territoire d’une Partie autre que celui où se trouve l’institution débitrice sera, à la demande l’intéressé, liquidée ou rétablie à partir de l’entrée en vigueur de la présente Convention.
1. Subject to the provisions of Articles X and XXI of this Convention, any benefit that was not paid or that was suspended by reason of the nationality of a person or by reason of a person’s residence in the territory of a Party other than that in which the institution responsible for payment is located shall, on application by that person, be paid or reinstated with effect from the entry into force of this Convention.

In this regard any benefit that was not determined and paid or that was suspended by reason of the nationality of the interested person or by reason of his residence in the territory of a State other than that in which the institution responsible for payment is located shall, on the request of the interested person, be determined and paid or reinstituted from the entry into force of this Agreement subject to the rights previously determined not having led to a cash settlement.

Except as otherwise provided in this Agreement, pensions, benefits, annuities and death allowances acquired under the legislation of one Contracting State are not subject to any reduction, modification, suspension, cancellation or confiscation by reason only of the fact that the beneficiary resides in the territory of the Contracting State other than the one where the institution or authority making the payment is located.

Unless otherwise provided for by this Regulation, cash benefits payable under the legislation of one or more Member States or under this Regulation shall not be subject to any reduction, amendment, suspension, withdrawal or confiscation on account of the fact that the beneficiary or the members of his/her family reside in a Member State other than that in which the institution responsible for providing benefits is situated.
