Sans préjudice de l’article 9, paragraphe 1 bis, les États membres peuvent maintenir ou introduire des péages et/ou des droits d’usage sur le réseau routier transeuropéen ou sur certains tronçons dudit réseau, ainsi que sur tout autre tronçon de leur réseau d’autoroutes qui ne fait pas partie du réseau routier transeuropéen, selon les conditions énoncées aux paragraphes 2, 3, 4 et 5 du présent article et aux articles 7 bis à 7 duodecies.
1. Without prejudice to Article 9 paragraph 1a, Member States may maintain or introduce tolls and/or user charges on the trans-European road network or on certain sections of that network, and on any other additional sections of their network of motorways which are not part of the trans-European road network under the conditions laid down in paragraphs 2, 3, 4 and 5 of this Article and in Articles 7a to 7k.

Therefore, inconsistent charging schemes should be avoided in order not to distort competition in international goods transport on the trans-European road network or on certain sections of that network, and on any additional sections of those interlinked networks or motorways which are not part of the trans-European road network.

Where Member States choose to maintain or introduce tolls and/or user charges only on parts of the trans-European road network in their territory and not on others, for reasons such as their isolation or low levels of congestion or pollution or where essential for the introduction of a new tolling arrangement, the choice of the parts of the network subject to tolls or charges should not discriminate against international traffic and should not result in distortions of competition between operators.

5. En outre, les États membres informent la Commission au moins quatre mois avant leur entrée en vigueur des nouveaux systèmes de péage applicables aux routes parallèles sur lesquelles le trafic peut être détourné du réseau routier transeuropéen et/ou qui sont en concurrence directe avec certains tronçons dudit réseau, sur lesquels des péages sont prélevés.
5. Member States shall also inform the Commission at least four months before their implementation of new tolling arrangements applicable to parallel roads to which traffic may be diverted from the trans-European road network and/or which are in direct competition with certain parts of that network on which tolls are levied.
