Therefore, given the explanations provided by Spain on the implementation of the provision, the Commission considered, at the time of the adoption of the First and Second decisions, that the scope of application of Article 12(5) TRLIS was limited to direct acquisitions of shareholdings of operating companies, fact which was also confirmed by the existence of a consistent and relevant administrative practice, which remained in place until 2012.
