À la veille de la commémoration du dixième anniversaire du massacre de Srebrenica, le Conseil européen souligne que la coopération pleine et sans restrictions des pays de la région avec le Tribunal pénal international pour l'ex-Yougoslavie (TPIY) reste une exigence essentielle pour la poursuite de leur rapprochement de l'Union européenne.
On the eve of the commemoration of the tenth anniversary of the Srebrenica massacre, the European Council underlines that full and unrestricted cooperation by countries in the region with the ICTY remains an essential requirement for continuing their progress towards the EU.

invites the Council to pursue without delay, within the appropriate UN structures, the procedures envisaged for a mechanism for dealing with the immediate and longer-term residual functions, concerning for example witness protection, protection from witness intimidation, contempt of court issues, reviews in the event of exculpatory evidence being received, monitoring of trials referred to the region (currently monitored by the Tribunal's Prosecution Service through the Organisation for Security and Co-operation in Europe (OSCE)), conditions of imprisonment and issues relating to pardon or commutation of sentences, etc; suggests that a proposal be put to the UN Security Council for the possible setting-up of a joint office to deal with the future residual functions of the Tribunal and of the International Criminal Tribunal for Rwanda and the Special Court for Sierra Leone;

All countries in the region must lend their full cooperation, and the International Criminal Tribunal should be given the chance to conclude its activities with due care.

5. reconnaît les progrès accomplis dans sa tâche difficile par le tribunal pénal international pour l'ex‑Yougoslavie, qui a fait rendre des comptes à certains des auteurs des massacres; considère toutefois que ces efforts doivent être menés à bien et, à cet égard, demande aux nouveaux gouvernements démocratiques des Balkans, en particulier aux gouvernements serbe et bosniaque, de coopérer sans réserve avec le tribunal pénal international pour l'ex‑Yougoslavie, rappelant que cette coopération est le préalable de relations plus étroites entre les pays de la région et l'UE;
5. Recognises the progress accomplished in its difficult work by the ICTY, which has brought to justice some of those responsible for the massacres; nevertheless considers that this work must be completed and in this respect calls on the new democratic governments in the Balkans, and in particular the Serbian and Bosnian Governments, to fully cooperate with the ICTY, recalling that such cooperation is a precondition for all the countries in the region to enjoy closer relations with the EU;

Un troisième consiste à obliger à répondre de leurs actes, voire devant un tribunal pénal, les gouverneurs et maires qui n'abrogent pas des lois en contradiction avec des lois fédérales et à créer, dans 21 districts, de nouveaux tribunaux administratifs dont relèvent les gouvernements des sujets et qui examinent la légalité des lois administratives normatives du gouvernement régional.
A third is establishing responsibility, even criminal responsibility, for governors and mayors who fail to rescind laws deemed to contradict federal law, and creating new administrative courts above the subject governments, in 21 districts, to provide review of the legality of normative administrative acts of regional government.
