TRADUCTIONS EN CONTEXTE

Au cours des six dernières années, nous avons grandement contribué à l'atteinte d'objectifs internationaux communs comme la convention sur les mines terrestres et le Tribunal pénal international.
Over the last six years we have taken significant initiatives to help achieve shared international objectives like the land mines treaty and the International Criminal Court.

Une loi nationale est-elle conforme à l’obligation d’un État membre de prévoir une poursuite pénale effective pour des infractions commises par des agents de douane, lorsqu’elle prévoit que la procédure pénale menée contre des agents de douane pour une participation à une organisation criminelle, dans le but de commettre des infractions relevant de la corruption dans l’exercice de leur fonction (de recevoir des sommes d’argent pour qu’ils n’effectuent pas de contrôle douanier), et pour des pots-de-vin concrets, ainsi que pour le recel de pots-de-vin recueillis, est clôturée sans que le tribunal examine sur le fond les accusations établies, dans les circonstances suivantes: a) le délai de deux ans à compter de l’accusation est expiré; b) le prévenu a présenté une demande de clôture de la procédure préliminaire; c) le tribunal a imparti au procureur un délai de trois mois pour clôturer la procédure préliminaire; d) le procureur a commis des «violations des formes substantielles» dans ce délai (à savoir, une communication irrégulière de l’accusation précisée, un défaut de communication des éléments de l’enquête et un réquisitoire contradictoire); e) le tribunal a imparti au procureur un nouveau délai d’un mois afin de remédier à ces «violations des formes substantielles»; [f)] le procureur n’a pas remédié à ces «violations des formes substantielles» dans ce délai, la commission de ces violations dans le premier délai de trois mois et le défaut d’y remédier dans le dernier délai d’un mois étant imputable tant au procureur (le fait de ne pas remédier aux contradictions dans le réquisitoire et le fait de n’entreprendre aucun acte réel durant la majeure partie de ces délais) qu’à la défense (le fait de ne pas collaborer, alors que cela est requis, à la communication de l’accusation et des éléments de l’enquête, s’agissant des prévenus, en raison d’une hospitalisation et, s’agissant des avocats, en raison d’autres engagements professionnels); [g)] est né dans le chef ...
Is a national law compatible with the obligation of a Member State to provide for the effective prosecution of criminal offences by customs officials if that law provides for criminal proceedings brought against customs officials — for participation in a conspiracy to commit corruption offences while performing their professional duties (accepting bribes for non-performance of customs inspections), and for specific bribery offences and concealment of bribes received — to be terminated, without the court having examined the charges brought, under the following conditions: (a) two years have elapsed since the accused was charged; (b) the accused has lodged a request for the pre-trial investigation to be concluded; (c) the court has given the prosecutor a period of three months to conclude the pre-trial investigation; (d) during that period, the prosecutor has committed ‘infringements of essential procedural requirements’ (failure properly to notify a supplementary charge, failure to disclose the investigation file, contradictory indictment); (e) the court has given the prosecutor a further period of one month to remedy those ‘infringements of essential procedural requirements’; ([f]) the prosecutor has failed to remedy the ‘infringements of essential procedural requirements’ within that time-limit — albeit that the infringements committed within the first three-month period and the failure to remedy them within the subsequent one-month period are attributable both to the prosecutor (failure to remove contradictions in the indictment; failure to take real action for most of those periods) and also to the defence (breach of the duty to cooperate with respect to notification of the charge and inspection of the investigation file due to the hospitalisation of the accused and claims regarding the lawyers’ other professional commitments); ([g]) the accused has acquired a subjective right to the termination of the criminal proceedings on account of the failure to reme ...

Underlines the need to develop more effective mediation guidelines and capacities through collaboration between the EU and the UN on mediation capacities, in order to provide adequate resources for mediation in a timely and coordinated manner, including through ensuring women‘s participation in these processes; considers it essential for the implementation of the EU’s human rights policy to develop the UN Human Rights Council’s capacity to address serious and urgent human rights situations, to reinforce the follow-up process on the implementation of recommendations of the Special Procedures and to strengthen the process of the Universal Periodic Review; stresses the need to continue the EU’s support of the International Criminal Court with the aim of contributing to the effective protection of human rights and the fight against impunity;

The Council adopted today by written procedure a common position aimed at supporting the effective implementation of the mandate of the International Criminal Tribunal for the former Yugoslavia by placing a travel ban on persons involved in the evasion of justice (doc. 8157/03).

C'est pourquoi il est de la plus haute importance que soit établi partout dans le monde un droit pénal uniforme pour punir les génocides et les crimes contre l'humanité. Il convient également que soient mis en place, à l'échelle mondiale, des peines uniformes et un tribunal pénal commun pour que chacun sache que, quels que soient les prétextes utilisés, quelles que soient l'idéologie ou la nationalité, le crime demeure le crime et le crime doit être puni.
It is therefore extremely important for there to be a uniform criminal law against genocide and crimes against humanity throughout the world and for there to be uniform sentences and a common criminal court throughout the world, where everyone knows that wrong is always wrong and must be prosecuted, irrespective of the charge, irrespective of the ideology and irrespective of the nationality under which they appear in court.

Pour l'instant, avec l'engagement actif du Haut Représentant, Carlos Westendorp, les éléments constitutifs d'une nation moderne se mettent en place : des institutions centrales et des instruments communs à tout le pays, comme une monnaie commune, sont en train d'être consolidés ; l'Etat de droit s'installe ; des progrès sont accomplis vers la liberté des médias ; les résultats des élections municipales ont été respectés à une exception près, qui n'est pas négligeable ; la liberté de circulation et le droit au retour deviennent une réalité et la coopération avec le Tribunal pénal international de La Haye est enfin bien engagée.
4. At the moment, with the active engagement of the High Representative, Carlos Westendorp, the necessary building-blocks of a modern nation are being put in place: central institutions and instruments such as a common currency are being consolidated; the rule of law is taking hold; progress is being made towards a free media; municipal election results, with one notable exception, have been implemented; freedom of movement and the right of return are becoming a reality and co-operation with the International Criminal Tribunal in the Hague is at last gathering momentum.

Parmi les grandes priorités de cette période devraient figurer : - le plein respect des droits de l'homme et des droits des minorités et la coopération avec les organismes de surveillance des droits de l'homme ; - une coopération sensiblement améliorée avec le Tribunal pénal international ; - la pleine coopération de toutes les parties avec le Haut Représentant et d'autres représentants de la communauté internationale ; - la mise en oeuvre de mesures spécifiques destinées à assurer la pleine liberté de circulation et de communication et à garantir le droit des réfugiés de retourner librement dans leur région d'origine, conformément aux dispositions de l'annexe 7 de l'Accord-cadre général pour la paix en Bosnie-Herzégovine ; - des programmes visant à accélérer le retour des réfugiés et des personnes déplacées.
Key priorities during this period should include: - full respect for human and minority rights and cooperation with human rights monitoring agencies - markedly improved cooperation with the International Criminal Tribunal - full cooperation by all parties with the High Representative and other representatives of the international community - implementation of specific measures to ensure full freedom of movement and communications and the right of refugees to return freely to their places of origin, in accordance with the terms of Annex 7 of the GFAP - programmes to accelerate the return of refugees and displaced persons.
