Appeal brought against the judgment of the General Court (First Chamber) of 4 February 2013 in Case T-159/11 Marszalkowski v OHIM — Mar-Ko Fleischwaren (WALICHNOWY MARKO), by which the General Court dismissed the action brought against the decision of the Fourth Board of Appeal of OHIM of 11 January 2011 (Case R 760/2010-4) which annulled the decision of the Opposition Division dismissing the opposition brought by the proprietor of the Community word mark ‘Mar-Ko’ in respect of goods in Class 29 of the Nice Agreement — Infringement of Article 8(1)(b) of Council Regulation (EC) No 207/2009 of 26 February 2009 on the Community trade mark (OJ 2009 L 78, p. 1) and Article 48(2) of the Rules of Procedure of the General Court — Relative ground for refusal — Likelihood of confusion

2. Where the jurisdiction of the court first seised is established, any court other than the court first seised shall decline jurisdiction in favour of that court.

Where proceedings involving the same cause of action and between the same parties are brought in the courts of different Member States, any court other than the court first seised shall of its own motion stay its proceedings until such time as the jurisdiction of the court first seised is established.

G. considérant que les résolutions S/RES/1503 (2003) et S/RES/1534 (2004), précitées, du Conseil de sécurité des Nations unies ont demandé que toutes les enquêtes du Tribunal et du Tribunal pénal international pour le Rwanda soient menées à bien à la fin de l'année 2004, que tous leurs procès en première instance soient achevés à la fin de l'année 2008 et que leurs travaux soient terminés en 2010; que le Tribunal a toutefois indiqué qu'il ne sera pas en mesure d'achever les procès en première instance avant la fin de l'année 2009, en raison également du grand nombre d'appels; considérant dès lors que le Conseil de sécurité des Nations unies doit adopter une nouvelle décision pour prolonger le mandat du Tribunal,
G. whereas the above-mentioned UN Security Council resolutions S/RES/1503 (2003) and S/RES/1534 (2004) called on the Tribunal and the International Criminal Tribunal for Rwanda to complete all investigations by the end of 2004, all first-instance trials by the end of 2008, and all work by 2010; whereas, however, the Tribunal has indicated that it will be unable to complete the first-instance trials before late 2009, also because of the great number of appeals; whereas, therefore, a new decision of the UN Security Council is needed in order to extend the mandate of the Tribunal,
