As regards the appellant’s complaint that the Court of First Instance required that the mark applied for be markedly different from similar marks which might exist in the confectionery sector, it is based on an incorrect interpretation of the judgment under appeal, since the Court of First Instance in no way sought to ascertain whether other marks used for that type of product were identical or similar to the mark applied for.

Par constitution de partie civile tendant à l'ouverture initiale d'une instruction, adressée le 6 juin 2007 à la Chambre pénale du Tribunal de Grande Instance de Vienne, la société fiduciaire Merkur "Wirtschaftstreuhand - und Steuerberatungs GmbH" a invité cette juridiction à condamner M. Hans-Peter Martin pour atteinte à la réputation d'autrui, conformément à l'article 152 du Code pénal autrichien. En effet, tant sur son site internet www.hpmartin.net que par voie de circulaire APA OTS OTS0189 5 II 0473 NEF006, M. Hans-Peter Martin aurait affirmé, à propos des accusations d'utilisation abusive de l'indemnité de secrétariat des collaborateurs, formulées à son encontre par l'OLAF (Office de lutte anti-fraude de l'UE), que des recherches approfondies auraient révélé qu'il n'avait nullement abusé des fonds communautaires et que seul un vice de forme de la part de son comptable d'alors, le conseiller fiscal Christoph Matznetter, nommé depuis Secrétaire d'État aux Finances au sein du gouvernement autrichien, aurait fait l'objet de critiques, celui-ci ayant comptabilisé par erreur trois ordinateurs d'assistants et deux factures téléphoniques sur l'indemnité de secrétariat, au lieu de les comptabiliser sur l'indemnité de frais de bureau.
A private prosecution has been brought against Mr Hans-Peter Martin in the Vienna Regional Criminal Court on 6 June 2007 by Merkur Treuhand Wirtschaftstreuhand- und Steuerberatungs Gesellschaft mit beschränkter Haftung for commercial defamation pursuant to Section 152 of the Austrian Criminal Code on the ground that, both on his website www.hpmartin.net and in APA-OTS press release OTS0189 5 11 0473 NEF0006 in connection with the accusations against him (by the EU anti-fraud authority OLAF) of improper use of the secretarial assistance allowance for staff, he had claimed that it had been established after a comprehensive, detailed investigation that he had in no way improperly used EU monies and that fault had been found only with a formal error on the part of his accounts manager at the time, Mr Christoph Matznetter, a tax adviser now State Secretary for Finance in the Austrian Government, who, according to Mr Martin, had incorrectly charged three staff computers and two telephone bills to the secretarial assistance allowance instead of to the office expenses allowance.
