Viasat constate que l’arrêt attaqué ne retient que l’interprétation de la décision attaquée, qui, selon le Tribunal, n’aurait été développée par la Commission qu’au cours de la procédure contentieuse, sans que le Tribunal ne tienne compte de la motivation de la décision attaquée.
Viasat observes that, in its judgment, the General Court considers solely the interpretation of the contested decision which the Commission, in the General Court’s view, ought to have submitted in its written pleadings before the General Court, without examining the statement of reasons in the contested decision.

The General Court went beyond what is prescribed by the relevant case-law, requiring of the economic operator a degree of diligence that is not possible in practice, given that the requirement that an application for aid be made before work commences is a Community rule which was introduced at exactly the same time as the facts of the case and, therefore, the undertaking could not have been aware of it at the time at which it made its decision.
