They are under the impression that the European Court of Human Rights falls under the authority of the EU or mistake the European Parliament for a judiciary and court of appeal when national authorities have failed to deliver the result that citizens expect or wish for. This is hardly surprising, considering the expectations raised by politicians in the run-up to the Lisbon Treaty, which includes the Charter of Fundamental Rights and foresees the EU signing up to the European Convention on Human Rights.
