A. considérant qu'Alexander Mirsky, député au Parlement européen, a demandé la défense de son immunité parlementaire en relation avec la procédure civile en instance devant la Cour suprême de la République de Lettonie; que la procédure en question se rapporte à la décision de la Chambre civile du Tribunal régional de Riga (ci-après «le Tribunal régional de Riga») de faire obligation à Alexander Mirsky de rétracter une déclaration faite dans une intervention devant le Parlement européen le 4 avril 2011 et de verser 1 000 LVL à titre de réparation du préjudice moral au bénéfice des demandeurs présumés lésés;
A. whereas a Member of the European Parliament, Alexander Mirsky, has requested the defence of his parliamentary immunity in connection with civil proceedings pending before the Supreme Court of the Republic of Latvia; whereas the proceedings in question relate to the decision of the Civil Division of the Riga District Court (hereinafter referred to as ‘the Riga District Court’) to require Alexander Mirsky to retract a statement made in a speech at the European Parliament on 4 April 2011 and to pay LVL 1000 in non-material compensation to the benefit of the allegedly prejudiced applicants;

As with all relationships between countries that are in close proximity to each other, there will still be difficulties in the future with regard to how Serbia will deal with the issue of Kosovo, their ongoing cooperation with the International War Crimes Tribunal, and in particular with regard to their relationships with other neighbouring countries that were formally part of Yugoslavia.

Whether or not the answer to Question 1 is in the affirmative, the District Court asks whether the provisions of the EEA Agreement on the free movement of workers, and in particular Articles 28 and 29, can be interpreted as meaning that a rule in the Articles of Association of Icelandic pension funds which makes a specific benefit right (the right to projection of entitlements) subject to the condition that the individual involved has paid premiums to an Icelandic pension fund that is a party to the Agreement on Relations between the Pension Funds, for at least 6 of the 12 months preceding the date of an accident, is compatible with the EEA Agreement when the reason why the individual is unable to meet this condition is that he has moved to another State within the EEA in order to pursue employment comparable to that which he pursued previously, and he has paid into a pension fund in that State?
