TRADUCTIONS EN CONTEXTE

Comme le relève la recommandation, ceci constitue une contrainte pour le processus décisionnel du Tribunal constitutionnel, particulièrement dans les conditions actuelles où ledit Tribunal ne compte que douze juges (étant donné que les trois juges légalement nommés en octobre 2015 par la 7 législature de la Diète n'ont pas pris leurs fonctions).
As pointed out in the Recommendation this represents a constraint on the decision-making process of the Constitutional Tribunal, in particular in the current circumstances where the Constitutional Tribunal has only 12 judges (since the three judges that were lawfully nominated in October 2015 by the 7th term of the Sejm have not taken up their judicial functions).

Au cours du débat en séance plénière du 14 décembre 2016 plus particulièrement, la Commission a demandé instamment aux autorités polonaises de ne pas mettre en vigueur les nouvelles lois avant que le Tribunal constitutionnel n'ait eu le loisir d'en examiner la constitutionnalité.

Nous appuyons aussi, dans le rapport de la Commission, l'idée d'inclure une clause d'interprétation qui pourrait guider le Tribunal des droits de la personne dans l'application de la Loi canadienne sur les droits de la personne à la situation historique et constitutionnelle particulière des peuples autochtones, de façon à éviter ce dépouillement massif qui pourrait résulter d'une décision du Tribunal des droits de la personne.
We also support, in the report from the commission, that there also be included an interpretive clause that would help then guide the Human Rights Tribunal in applying the Canadian Human Rights Act to the specific historical and constitutional circumstances of aboriginal people, so that you don't get this wholesale disentitlement as a result of a Human Rights Tribunal decision.

I believe that the problem is not as simple as Commissioner Vitorino has suggested – as Mrs Kaufmann has stressed – because it is not simply a question of imposing the European Court of Human Rights on a Constitutional Court, but rather of a supranational construction – a Community construction – with a Court of Justice that has very particular characteristics, and imposing a different procedure on it.
