En décembre 2015, le Tribunal constitutionnel fédéral allemand a considéré que, dans certains cas individuels, la protection des droits fondamentaux peut inclure l’examen d’actes déterminés par le droit de l’Union si cela est indispensable pour protéger l’identité constitutionnelle garantie par l’article 79 de la loi fondamentale allemande.
In December 2015, Germany's Federal Constitutional Court held that, in individual cases, protection of fundamental rights can include the review of acts determined by Union law if this is indispensable to protect the constitutional identity guaranteed by Article 79 of Germany's Basic Law.

Mon interprétation, c'est que même si le tribunal constitutionnel allemand n'a pas jugé inconstitutionnelle la principale loi de ce pays en matière de stupéfiants, il a quand même rendu une décision judiciaire selon laquelle la possession de petites quantités de cannabis destinées exclusivement à un usage personnel ne devrait pas être matière à accusation.
It is my understanding that while the German constitutional court has not ruled their basic drug law unconstitutional, it has nonetheless provided a judicial decision that prosecutors should not pursue prosecution for possession of small amounts of cannabis for personal use alone.

While there may be similarities between the test applied by the national court for the purposes of German constitutional law and the assessment which the Commission has to carry out under Article 107(1) of the Treaty, it follows from the case-law of the Court of Justice that resources do not need to flow into the State budget or be the property of the State to be considered State resources.
