4. À moins que les Parties contractantes n’en décident autrement d’un commun accord, le tribunal arbitral sera composé de trois arbitres, desquels un sera nommé par chacune des Parties contractantes, et ces deux arbitres ainsi nommés nommeront à leur tour une tierce personne qui agira à titre de président; toutefois, si une des Parties contractantes ne parvient pas à nommer son arbitre ou si les deux arbitres ne peuvent s’entendre, l’autorité compétente de l’autre Partie contractante invite le Président de la Cour internationale de justice de nommer l’arbitre de la première Partie contractante ou les deux arbitres invitent le Président de la Cour internationale de justice de nommer le président du tribunal arbitral.

Unless the Contracting Parties mutually determine otherwise, the arbitral tribunal shall consist of 3 arbitrators, of whom each Contracting Party shall appoint one and the 2 arbitrators so appointed shall appoint a third who shall act as president; provided that if either Contracting Party fails to appoint its arbitrator or if the 2 arbitrators fail to agree, the competent authority of the other Contracting Party shall invite the President of the International Court of Justice to appoint the arbitrator of the first Contracting Party or the 2 appointed arbitrators shall invite the President of the International Court of Justice to appoint the president of the arbitral tribunal.
