IN-CONTEXT TRANSLATIONS

1. Tout différend entre deux ou plusieurs Parties Contractantes concernant l’interprétation ou l’application de la présente Convention qui ne peut être réglé par voie de négociations ou d’une autre manière sera soumis, à la requête de l’une d’entre elles, à un tribunal arbitral composé de la façon suivante : chacune des parties au différend nommera un arbitre et les deux arbitres désigneront un troisième arbitre qui sera le Président du tribunal.
1. Any dispute between two or more Contracting Parties concerning the interpretation or application of the present Convention which cannot be settled by negotiation or other means of settlement shall, at the request of one of them, be referred to an arbitration tribunal composed as follows: each party to the dispute shall appoint an arbitrator and these two arbitrators shall appoint a third arbitrator, who shall be the Chairman.

2. Tout différend entre les deux États relatif à l’interprétation ou à l’application de la présente Convention qui n’a pas été résolu conformément au paragraphe premier, doit être, à la demande de l’un des États, soumis à un tribunal arbitral composé de trois membres.
2. Any disagreement between the two States concerning the interpretation or application of this Convention which has not been settled in accordance to paragraph 1 shall be submitted, at the request of one of the States, to an arbitral tribunal of three members.

Unless the Parties mutually determine otherwise, the Commission shall consist of 3 arbitrators of whom each Party shall appoint one and the two arbitrators so appointed shall appoint a third who shall act as President; provided that if any Party fails to appoint an arbitrator within 30 days from the date on which one or both Parties has requested the difficulty be submitted to an arbitration commission, or in the event of a disagreement over the appointment of the President of such commission, the President of the International Court of Justice shall be requested by one or both Parties to appoint the arbitrator or as the case may be, the President of the arbitration commission.

Unless the Contracting Parties mutually determine otherwise, the arbitral tribunal shall consist of three arbitrators, of whom each Contracting Party shall appoint one within two months from the date of receipt of the request for arbitration, and the two arbitrators so appointed shall appoint, within two months after the last notice of appointment, the third who shall act as president; provided that if either Contracting Party fails to appoint its arbitrator or if the two appointed arbitrators fail to agree about the third, the competent authority of the other Contracting Party shall invite the President of the International Court of Justice to appoint the arbitrator of the first Contracting Party or the two appointed arbitrators shall invite the President of the International Court of Justice to appoint the president of the arbitral tribunal.
