The General Court found that the very nature of the preferential tariff, that is to say, the fact that Alcoa Transformazioni was reimbursed the difference between the electricity prices charged by ENEL and the rate provided by the 1995 decree, is enough to conclude that the undertaking concerned was not bearing all the charges which should have normally burdened its budget (28).
