Since the objective of this Regulation, namely to establish a specialised body to formulate common solutions on matters concerning railway safety and interoperability, cannot be sufficiently achieved by the Member States but can rather, by reason of the joint nature of the work to be done, be better achieved at Union level, the Union may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.

82. 82. If necessary in order to ascertain whether any mining or prospecting operations have been carried on so as to injure or be detrimental to a pipeline or its safety or security or the safety or security of the public, a company may, with the written permission of the Board and after giving twenty-four hours notice in writing, enter on any lands through or near which its pipeline passes where any mining or prospecting operations are being carried on, and enter into and return from the site of the operations, and for those purposes the company may make use of any apparatus used in connection with the operations and use all necessary means for discovering the distance from its pipeline to the place where the operations are being carried on.

9. 9. When the Agency makes an order under section 7 requiring a railway company to cease to operate over a line within a transportation study area, the Agency may recommend that the Minister of Public Works and Government Services acquire any land that is or was occupied as part of its railway undertaking by the railway company subject to such conditions as the Agency may prescribe, and the Minister of Public Works and Government Services may acquire such land by purchase or by expropriation under the Expropriation Act.

42 (1) Where the Crown has contracted with any person for the construction or execution of any public work, or where, by direction of the Governor in Council, or of a Minister within the scope of the powers of the Minister, any officer, employee or agent of the Crown is charged with the construction or execution of any public work, the Governor in Council may, if in the opinion of the Governor in Council it is necessary or expedient that any material be excavated or removed by blasting or the use of explosives, authorize the work to be performed in that manner, notwithstanding that the blasting or explosions may cause damage to land or other property or to the prosecution of any industry or work that is situated in the vicinity of the work or that may be thereby affected.

In procedures for awarding contracts having as their object supplies requiring siting or installation work, the provision of services and/or the execution of works, the ability of economic operators to provide the service or to execute the installation or the work may be evaluated in particular with regard to their skills, efficiency, experience and reliability.

A contract shall be deemed to be a works contract only if its subject-matter specifically covers the execution of activities under Division 45 of the ‘Common Procurement Vocabulary’ laid down by Regulation (EC) No 2195/2002 of the European Parliament and of the Council of 5 November 2002 on the Common Procurement Vocabulary (CPV) (hereinafter the ‘CPV), even if the contract covers the provision of other services necessary for the execution of such activities.
